1. Introduction

Welcome to Machina Guitars Inc. ("we," "us," or "our"). By visiting our website and/or purchasing a custom guitar from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms"). Please read these Terms carefully before using our website or placing an order.

 

2. Custom Orders and Specifications

Custom-built instruments are made strictly according to your selected or requested specifications. By placing a custom order, you acknowledge and agree to the following:

  • Finality: Custom shop orders are non-cancellable, non-returnable, and non-refundable once production has begun.

  • Variations: Because our guitars are handcrafted, final products may vary slightly from mockups, renderings, reference images, or descriptions due to natural wood grain, material limitations, and necessary production adjustments.

  • Accuracy: You are solely responsible for ensuring the accuracy of your submitted specifications (scale length, wood choices, hardware, electronics, and finishes).

 

3. Payment Terms

  • Deposits: A non-refundable deposit (e.g., $X% of the total build cost) is required to secure your spot in our build queue.

  • Final Balance: The remaining balance, plus shipping and applicable taxes, must be paid in full before the instrument is shipped or delivered.

  • Delays: We will provide estimated completion dates, but handmade custom builds are subject to unexpected delays. Delays do not constitute grounds for order cancellation or refunds.

 

4. Shipping and Delivery

  • We carefully package all instruments in premium hard-shell cases and shipping boxes.

  • Once the final balance clears, we will provide tracking information.

  • We are not responsible for delays caused by the courier, customs, or weather, nor are we liable for damages or loss occurring during transit. We recommend purchasing optional transit insurance.

 

5. Returns and Refunds

Due to the personalized nature of our products, all custom guitar sales are final. We do not accept returns or offer refunds for "change of mind" or buyer's remorse. If your guitar arrives with structural damage caused by transit, you must contact us within 48 hours of delivery with photographic evidence so we can file a claim with the carrier.

 

6. Intellectual Property

All content included on this website, including but not limited to guitar designs, photographs, logos, text, and graphics, is the property of Machina Guitars Inc. and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or use our intellectual property without our express written permission.

 

7. Limitation of Liability

To the maximum extent permitted by law, Machina Guitars Inc. shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from the use of our website or any instruments purchased from us. Our total liability shall not exceed the total price paid for the specific custom guitar.

 

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Alberta, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

 

9. Changes to Terms

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms and Conditions by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
